Apply for employment of a pregnant or breastfeeding woman between 8 p.m. and 10 p.m

Prerequisites

• You can only submit the application if you are an employer.
• The pregnant or breastfeeding woman must expressly agree to this
• A medical certificate must not speak against employment until 10 p.m.
• An irresponsible endangerment for the pregnant woman by working alone is excluded.
• An irresponsible endangerment of the child by working alone is excluded.

• Consent statement of the pregnant or lactating woman. The woman can revoke your declaration at any time.
• Evaluation of the working conditions according to § 14 paragraph 1 Maternity Protection Act

This procedure for approving employment between 8:00 p.m. and 10:00 p.m. does not replace notification under the Maternity Protection Act. Use the available forms or this online service.

Deadlines

The application must be submitted between 8:00 p.m. and 10:00 p.m. before the pregnant or breastfeeding woman is employed.

Procedure

You can apply for a permit to employ a pregnant or breastfeeding woman between 8 p.m. and 10 p.m. in writing or online.

You can apply for permission in writing:

• Describe your request informally.
• Submit your application to the Occupational Health and Safety Office, including the required documents and evidence.
• If the documents or information required for processing are incomplete, you will be contacted immediately by the clerk.
• The Office for Occupational Safety checks the documents
• Your application is considered approved if you do not receive a rejection within 6 weeks.
• If the requirements for approval are not met, you will receive a rejection.
• The Office for Occupational Safety and Health can also issue you with a provisional rejection,
• If you are rejected, you will receive a rejection notice. You will not receive a notification of approval.

• Complete the fields of the online service and send the application to the Office for Occupational Safety and Health including the documents and evidence listed in the application.

§ 28 paragraph 1 Maternity Protection Act (MuSchG)

If you want to employ a pregnant or breastfeeding woman between 8 p.m. and 10 p.m., you must obtain permission to do so.

The Office for Occupational Safety and Health can temporarily prohibit you from employing the pregnant or breastfeeding woman during this period in order to ensure the protection of the health of the woman or her child.

If the supervisory authority does not temporarily prohibit the employment, you may employ the woman between 8 p.m. and 10 p.m.
