Procedure

You can transmit the first notification of home work either in classic written form or with the online service.
Written process:

• You create an advertisement in which you state your company name, address, company location and the type of employment.
• You must send the postal notification to the Consumer Protection Authority - Employee Protection.
• After receiving the notification, the authorities will check your notification.
• As a rule, you have complied with your duty of disclosure and no further action is required from you. You will not receive an acknowledgment of receipt either
• You will only be contacted if there are any queries or if a correction needs to be made.

Online service process:

• You register in the online service and create your ad.
• The online service automatically carries out a determination of responsibility and sends the advertisement after completion of the creation.
• The rest of the steps are the same as in the written process.

§ 7 Home Work Act (HAG)

Companies that offer home work for the first time must inform the responsible authority in advance. This also applies if only irregular or minor activities are planned. Working from home includes, for example, product tests or translation work. The basis is the Home Work Act (HAG). It protects people who work in their own home or in a business location of their choice for companies or subcontractors. The law is intended to prevent disadvantages compared to conventional jobs. Protections for homeworkers are non-negotiable. Individual agreements that violate this are invalid. When it comes to remuneration for homework, companies are bound by labor law and collective bargaining regulations.
