Submit proof of collective disposal using the privileged procedure

Prerequisites

• Software with which the verification documents can be created, processed and qualified in electronic form and exchanged with other companies and the authorities.
• To sign the forms qualifiedly, you need a personal signature card and a card reader.
• In the verification forms you must enter the waste law company numbers of the waste collecting and waste disposal company. If these have not yet been issued, you must apply for them from the responsible authority before creating the verification forms.
• As a waste disposal company, you must meet one of the required requirements:
  • Waste disposal company
  • EMAS certification
  • Exemption from the authority
• It must be a type of waste that is listed in Appendix 2 of the Evidence Ordinance. Please consult the responsible authority about this.

Procedure

• The waste collecting company creates the necessary documents and sends them with a corresponding signature to the waste disposal company.
• The waste disposal company signs and completes the documents
• The waste disposal company sends the complete proof of disposal to the authority responsible for the disposal facility and the company that collects the waste before disposal begins.

Processing time

Processing takes place immediately upon receipt. Any additional demands or orders from the responsible authority are usually made within a few days.

The proof requirements and registration obligations under the Circular Economy Act (KrWG) aim to document and monitor the proper disposal of waste.

As a waste-producing company that produces hazardous waste, you and the companies involved in its disposal must demonstrate, both to each other and to the responsible authorities, that they have been properly disposed of and maintain the necessary documentation. Even before disposal begins, as a company generating or disposing of waste, you must provide proof of disposal in order to prove the admissibility of the planned type of disposal

However, if you generate less than 20 tonnes of hazardous waste per year, you can take part in the collective disposal verification process instead. In this case, it is not the company that produces the waste that provides proof of disposal, but rather the company that collects the waste. Even in the collective disposal verification process, the responsible authority must usually confirm the admissibility of disposal before disposal begins. The obligation to confirm proof of collective disposal does not apply in the so-called privileged procedure. This applies to the following companies:

• Waste disposal facilities that are certified as specialist waste disposal companies
• Waste disposal facilities that belong to a company registered in the EMAS register
• Waste disposal facilities that are exempt from the confirmation requirement upon application by the responsible authority.

In the privileged procedure, you can begin disposal immediately after sending the collective disposal certificate to the responsible authority
