Under certain conditions, you can use the privileged procedure for your disposal certificate.

Important notes

Prerequisites

  • Software with which the verification documents can be created, processed and qualified in electronic form and exchanged with other companies and the authorities.
  • A personal signature card and a card reader are required to sign the forms in a qualified manner.
  • The waste disposal company numbers of the producer and disposal company must be entered in the verification forms. If these have not yet been issued, they must be applied for from the responsible authority before the proof forms are created.
  • The waste disposal company must meet one of the required requirements:
    • Waste disposal company
    • EMAS certification
    • Exemption from the authority

  • As a waste-generating company, you create the cover sheet, the responsible declaration, if necessary including the declaration analysis, in electronic form and send it with a signature to the disposal site

The proof requirements and registration obligations under the Circular Economy Act (KrWG) aim to document and monitor the proper disposal of waste.

As a waste-producing company that produces hazardous waste, you and the companies involved in its disposal must demonstrate, both to each other and to the responsible authorities, that they have been properly disposed of and maintain the necessary documentation.

Even before disposal begins, you as a waste-producing company must provide proof of disposal in order to prove the admissibility of the planned type of disposal. The responsible authority must confirm to you that disposal is permissible before disposal begins.

The obligation to confirm proof of disposal does not apply in the so-called privileged procedure. This applies to

  • Waste disposal facilities that are certified as specialist waste disposal companies or
  • Waste disposal facilities that belong to a company registered in the EMAS register or
  • Waste disposal facilities that have been exempted from the confirmation requirement upon request by the responsible authority.
In the privileged procedure, you can begin disposal immediately after sending the proof of disposal to the responsible authority.
