Declaration of the adoption applicants to adopt the proposed child

Prerequisites

As part of the adoption process, the international placement office must have asked you to submit a declaration in accordance with Section 7 (1) AdÜbAG and you must be willing to adopt the child proposed to you.

Documents required

Identity must be proven for certification. You must therefore be able to identify yourself with an identity card, passport or comparable documents.

Please note

The declaration of willingness to adopt a child must be publicly certified. This is possible in a notary's office and in a youth welfare office.

Deadlines

If the foreign exchange office asks you to certify your declaration, it will set you a deadline by which the certification must be done. If you cannot meet this deadline for compelling reasons, but want to adopt the child proposed to you, you must contact the international placement office to request an extension of the deadline.

Procedure

If the international placement office has asked you to submit a declaration in accordance with § 7 Para. 1 AdÜbAG and you are willing to adopt the child proposed to you, contact the office where you would like to have the certification carried out. It is best if an appointment is made with the office that is to record the certificate. Before the certification, the person who records the certificate informs about the legal consequences of the certification.

Processing time

The necessary legal instructions and questions that may need to be asked before the certification take a lot of time. The time required is different in each individual case. In addition, there may be a waiting time on site.


It is advisable to make an appointment for the certification.

Fees

The notarial certification incurs costs in accordance with the applicable fee schedule. The notary's office can inform you of the exact amount of the costs before notarization. The public notarization of the declaration before the notary of a youth welfare office is free of charge.

If you are interested in adopting a child from abroad and a child can be proposed to you for adoption, you will be asked by the international placement office to submit a declaration that you are willing to adopt this child. A specific form is required for this declaration. The declaration must be "notarised". This certification can be done in a notary's office or in a youth welfare office. The certification in the youth welfare office is free of charge. There are costs for notarization in a notary’s office. If you agree to adopt the child proposed to you, you are obligated to reimburse various public benefits provided for the child. This obligation exists for a maximum of six years from the child's entry into the country and ends when the child is adopted. There is no reimbursement obligation for services provided for the child if the child already lives in your household but has not yet been adopted. In these cases, you only have to pay a fee to the same extent as parents would have to. The same applies to benefits that would also have to be granted if the child were already living in your household.
