Apply for a traffic restriction permit

Prerequisites

• You must demonstrate a legitimate interest.
• They must not restrict the safety of traffic and must not disproportionately impair the ease of traffic.
• They must not unreasonably restrict public use.
• As the person responsible for an order under traffic law, you must be the holder of the certificate "Instruction sheet on the framework conditions for the necessary specialist knowledge for traffic safety at work sites on roads" (MVAS).

Please note

There are the following hints:
The traffic area may only be restricted after the traffic law order has been issued.
If the restricted traffic area applied for is a job, a site manager must be named.
If the action takes longer than the requested period, you must apply for an extension of the action before the approved time expires.
The applicant must inform the public about the measure.

Procedure

There are different types of traffic restrictions. The same procedure applies to all types of traffic area restrictions. You can submit the application in writing, electronically or via the online service. The online service is currently under development and will then be made available to you. The procedure is always the same.

• You submit the application with the required documents.
• The competent authorities examine the application and, if necessary, involve other bodies.
• After the application has been checked, you will receive a notification of approval or rejection. The approval notice contains the traffic regulations for you.
• You can now carry out the measure within the framework of the traffic law order.

In the event of an accident (emergency measure), contact the responsible police station directly.

Approval must be obtained for every measure that requires a restriction and special use of public traffic space. This is the case, for example, with road construction measures. But this also includes the use of public traffic when erecting scaffolding or storing building materials. For the execution of such work, it is specified, for example,

• how the work site is to be cordoned off and marked,
• whether and how traffic is to be restricted, directed and regulated and
• how any detour routes are to be marked.

If you use the public traffic space in this way, you must obtain a traffic law order before starting work. You will receive this when you apply and is intended to ensure the safety of the construction workers in the traffic area and the safety of all road users. On the other hand, it should ensure that traffic is not affected more than necessary.
You need a traffic law order not only in the case of a full or partial lane closure, but also if the work only affects cycle paths or sidewalks.
