Restaurant surveillance

In Hamburg, nighttime quiet hours (10 p.m. to 6 a.m.) are protected. During this time, all activities that could disturb the peace are prohibited.

Detailed description

In Hamburg, the period from 10 p.m. to 6 a.m. is protected as a night's rest. During this time, all activities that could disturb the peace are prohibited. Furthermore, the use of sound-generating and sound-reproducing devices is regulated. Even outside of the legally protected night's rest period, these devices may only be operated at a volume that does not significantly disturb uninvolved persons.

Violations of these regulations constitute an administrative offense that can be punished with a fine.

Please note

Disturbances emanating from a restaurant that are not attributable to technical equipment – for example, loud guests, excessive outdoor use, smoke or odors from open doors and windows – are regulated by the district restaurant departments of the consumer protection, trade and environment offices.

The situation is different with regard to odor and noise pollution from technical installations. In the case of odor pollution from exhaust air systems, technical environmental protection is responsible, particularly within the framework of immission control.
