Hamburg District Court
District Court, Ship Register
Among other things, ownership and mortgages on the ship are documented in the ship register.
Important notes
Prerequisites
Since the cases are very different, not all entry modalities can be presented here. So just a few general notes:
For the first registration of a seagoing vessel, please submit an application with proof of ownership, a copy of the owner's identity card and the tonnage certificate. You can obtain the latter from the Federal Maritime and Hydrographic Agency. You must also prove that the ship is not entered in any other ship register. A change of ownership for seagoing vessels already registered in Germany takes place outside the ship register, but the old and new owners are legally obliged to correct the ship register with regard to the ownership situation. For reasons of legal certainty, buyers and sellers should apply for this immediately with the responsible ship register. The declarations on the transfer of ownership must be notarized. If a company is the owner of the ship, a current certified excerpt from the commercial register must also be submitted with the first entry. In the case of subsequent disposals of the ship, which are to be entered in the register, the right of representation of the persons acting for the company must be proven.
An application with proof of ownership and the calibration certificate is required for the first registration of an inland waterway vessel. You can obtain the latter from the responsible ship calibration office. The change of ownership for inland vessels already registered in Germany usually takes place through a notarized declaration of agreement and entry in the inland vessel register.
The following applies to seagoing and inland waterway vessels to be newly entered: If the ship was already entered in another ship register, you must provide evidence of the deletion in the previous ship register. If the ship was not previously registered, you must make this fact credible.
Application and registration forms are available from the ship register office. Registration forms for the first entry of yachts and cargo ships in the seagoing ship register and inland waterway vessels in the inland waterway ship register are available for download on this page.
If you would like to have a ship registered with us deleted, the ship's certificate and - if issued - the officially certified excerpt from the ship's certificate must be submitted with the request for deletion. In the case of inland vessels, the ship's letter must be submitted with the request for cancellation. Deletion is only possible in any case if no more charges are entered in the ship's register.
If you have any questions about the forms or the exact entry modalities, we are at your disposal. However, we do not provide legal advice.
Please note
Only for inland and sea vessels with a home port/hometown in the federal states of Hamburg, Berlin, Brandenburg, Baden-Württemberg, Bavaria and on the Hesse part of the Neckar.
Seagoing vessels whose hull length exceeds 15 meters are subject to registration. Inland vessels with a water displacement of ten cubic meters or a carrying capacity of at least 20 tonnes are subject to registration.
It is not possible to submit an application by email.
