If you intend to operate an energy supply network, you must apply for approval in advance.
Important notes
Prerequisites
They must have the personnel, technical and economic performance and reliability to ensure long-term network operation in accordance with the provisions of the Energy Industry Act.
Documents required
General evidence:
- Explanations of the legal form of the network operator and, if applicable, its integration into a group of companies
- If applicable: Explanation of the respective corporate purposes of the individual companies involved
- Commercial register extract
- Depiction of the local area of application of the requested permit with a field plan and information as to whether it concerns exclusively private property or whether public property is also affected
- Written explanation of the network operation concept, including an explanation of how a safe, inexpensive, consumer-friendly, efficient and environmentally friendly power supply for customers is ensured
- Technical overview plan (network map with legend) in which the supply and consumption situation (including the customer structure, number of households supplied and the amount of energy expected to be transmitted) is shown
- List and technical data of all systems belonging to the network, unless shown in the technical overview plan
- Submission of all relevant operator, management, lease or other contracts relating to the ownership or operation of the network
To prove personnel performance:
- Name of the responsible and responsible persons for network operation and proof of their technical and commercial expertise (description of qualifications, CV, copy of ID card)
- Organizational chart/position plan of the network operation
To prove technical performance:
- Explanation of how compliance with the requirements for technically secure network operation is ensured
- Self-declaration to Section 49 EnWG, see appendix
- Proof of compliance with the requirements
- DIN VDE 1000-10 requirements for people working in the field of electrical engineering
- VDE-AR-N 4001 Application rule: 2011-04 Requirements for the qualification and organization of companies for the operation of electricity supply networks (S 1000)
- Explanation of the measures for troubleshooting and hazard prevention (risk management)
To prove economic performance:
- Annual reports/financial statements of the companies involved for the last three years
- Proof of insurance
- Investment plan for the next 5 years
- Financing plan
To prove reliability:
- Self-declaration of reliability

Procedure & Fees
Procedure
To obtain approval, you must submit an application to the relevant authority. The approval will be granted to you by the responsible authority after checking your suitability for operating an energy supply network.
Processing time
The responsible body will decide on the application within six months of the complete application documents being available. Therefore, make sure you apply on time.
Fees
The fee range is between €500.00 and €8,500.00, depending on the effort involved
