The responsible authority is responsible for pollution control on construction sites. This includes emissions such as construction noise, dust and light emissions.

Detailed description

The Office for Building Regulations and Civil Engineering is responsible for pollution control at construction sites. This includes:

  • Control and monitoring of emissions protection for passers-by (e.g. construction noise and dust)
  • Advice and information for all those involved in the construction

This does not include:

  • Construction sites with hazardous substances, such as asbestos or mineral fibres
  • Occupation of public areas by construction materials or vehicles
  • Work on federally owned railways
  • Advice and information on construction types, building permits, etc.

Prerequisites

You are significantly affected by construction noise or dust from a nearby construction site.

Documents required

  • In your complaint, describe precisely what kind of disruption is occurring. State as precisely as possible when and where it is occurring (e.g., "for two weeks, daily from 8:00 a.m. to 5:00 p.m., at the construction site at Musterstraße 10").

Please note

There are legal regulations to limit emissions from construction sites (e.g., construction noise and dust). Work may only be carried out at certain times, and measures must be taken to control dust. If you file a complaint, the responsible authority will investigate whether these regulations are being complied with.



The Office for Building Regulations and Civil Engineering is responsible for the safe operation of construction sites and pollution control. These include:

  • Control and monitoring of occupational safety for employees on construction sites
  • Control and monitoring of pedestrian safety
  • Control and monitoring of emissions protection for passers-by (e.g. construction noise and dust)
  • Advice and information for all those involved in the construction

Deadlines


  • There is no general deadline for filing a complaint about construction noise or dust.

  • The sooner you submit your complaint, the faster the responsible authority can examine the situation and intervene if necessary.

  • Noise-intensive construction work is prohibited on working days between 8:00 p.m. and 7:00 a.m. and is only permitted with a special permit.

Procedure

  • If you have any problems or suggestions, please contact the responsible department by phone or email. Describe the problem as precisely as possible. If possible, include receipts or photos.
  • The responsible authority will receive your information and review it.
  • The responsible authority checks compliance with the regulations on the construction site.
  • The construction company or client will be notified of the complaint and, if appropriate, invited to comment. A hearing will be held if necessary.
  • Depending on the result, the following steps can be taken:
    • No action if no violation is found
    • Notice or requirement to the construction company (e.g. reduction of work at certain times, dust protection)
    • Order or decree (e.g. restriction of working hours, technical measures, emergency measures)
    • Fines if a violation of regulations is found
  • You will receive feedback.
