Protection and preservation of living space is an important issue of housing stock policy. An essential instrument is the Hamburg Housing Protection Act - HmbWoSchG from 1982.
The Hamburg Housing Protection Act contains a number of regulations aimed at ensuring that apartments can be used at any time without significant impairments, dangers and nuisances. These include regulations on minimum requirements, repairs, overcrowding, the storage of objects or materials and the keeping of animals.
Since 1971, there has been an uninterrupted ban on the misappropriation of living space in Hamburg. An apartment is misused if it is not used for living.
