Apply for approval for the construction, modification, change of use and removal of facilities using a simplified procedure

For certain construction projects you can apply for approval using a simplified procedure.

For the

  • construction,
  • Change (e.g. conversion),
  • Change of use (for example, conversion of a shop into an apartment) and
  • the demolition of buildings and other structures

You usually need a building permit.

When applying for a building permit, you can choose between the simplified procedure and the concentrated procedure. In the simplified procedure, the responsible authority only checks compliance with some of the building regulations. Therefore, the simplified procedure is the quickest and most cost-effective way to obtain your building permit. However, as the builder, you must still comply with all public law regulations that specify how, where and what you can build - but this is the responsibility of your draftsman (your person authorized to submit building plans). The simplified procedure is mainly used for housing construction matters and is limited to certain projects.

Prerequisites

The prerequisites for issuing a building permit must be checked in each individual case.

Documents required

The specific documents depend on the individual case. Depending on the project, different documents will be required from you. Please ask the responsible authority which documents you need to submit for your specific construction project. The following documents may be required, among others:

  • Extract from the official land register,
  • Site plan,
  • Construction drawings,
  • Building description.
  • if applicable: proof of stability, proof of fire protection

Please note

A complete building application is an essential prerequisite for the smooth running of the procedure. An application may only be submitted by a person authorized to submit building plans, usually an architect or a civil engineer.

Bear in mind that you may still need permits from other authorities in the simplified procedure. You must check for yourself whether all legal areas of the building regulations and ancillary building law are complied with. If you would rather have everything from a single source, you should choose the concentrated procedure.

If there are doubts about the basic approval of the building project, you can have these clarified at an early stage with a preliminary building permit. However, this only answers individual questions and does not replace the required building permit.

Your building application may be rejected if the documents are not complete after repeated requests.

Advice outside of ongoing approval procedures is subject to a fee

Deadlines

Application deadline: None. However, you must have the building permit before you start construction work.




You must start construction within 3 years of receiving planning permission.

Procedure

  • You or your person authorized to submit building plans submit an application for approval together with all necessary documents to the responsible authority.
  • If necessary, the responsible authority will ask you to pay a fee in advance. You make the payment.
  • If any documents or information are missing, the responsible authority will request them from you.
  • The competent authority will examine your application and involve other authorities whose consultation is necessary.
  • If all requirements are met, you will receive the building permit.
  • You will receive a fee notice and pay the fees.

Processing time

The processing time depends on the scope of the project applied for and can take 1 to 3 months after the required documents have been submitted in full.

Fees

In the case of new buildings, conversions and extensions, the fees are based on the eligible costs or the production costs.


  • for every EUR 1,000.00 of eligible costs: EUR 20.50

  • for every EUR 1,000.00 of production costs: EUR 13.70

Minimum fee: 64.70 EUR
