Request deletion from the debtors' register

Entries in the debtors' register are automatically deleted after 3 years. You can find out how to request the early deletion of an entry here.

Detailed description

The debtors' register is an official register in which individuals and companies are entered who do not meet their payment obligations and against whom certain enforcement measures have been unsuccessful.

It is maintained at the local court. Debtors are registered, for example, those with...

  • the asset disclosure was submitted,
  • the disclosure of assets was refused or
  • an enforcement attempt was unsuccessful.

The entries are generally stored for 3 years. After that, they are deleted unless new reasons arise.

Under certain conditions, you can have an entry in the debtors' register deleted before the regular 3-year period has expired. This is called early deletion.

Information

Prerequisites

You can request early deletion of an entry from the debtors' register if

  • You have fully paid the underlying amount or
  • the entry was based on false information or
  • the enforcement measure was unlawful or
  • the registration order has been revoked or temporarily suspended.

Documents required

Please specify the exact entry order that you wish to have deleted in your application.

If the deletion is to take place because you have paid the debts in full:

  • suitable documents to prove how
    • Confirmation from the creditors regarding the full payment of the claim, stating the file number, as well as
    • Additionally: Confirmation from the bailiff that the registration has been made for these creditors.
    • Alternatively: Confirmation from the enforcement authority stating the file number of the entry and the procedure number regarding the full settlement of the claim, provided that the payment was made there or
    • Alternatively: Original of the enforceable copy of the enforcement order, provided that the file number of the bailiff's registration (file number DR II-…) is stamped on it.
    • A receipt or proof of payment is not sufficient.

If the deletion is to be carried out due to the absence or cessation of the reason for registration:

  • Proof of the relevant circumstance by means of a public document or comparable evidence

If the deletion is to be carried out because of an enforceable decision that contradicts the registration, please submit it.
