Prerequisites
- To operate an amusement arcade, you must possess the necessary reliability. You generally do not possess this if, within the last three years before applying, you have been convicted of a crime, theft, embezzlement, extortion, receiving stolen goods, money laundering, concealment of unlawfully obtained assets, fraud, breach of trust, unauthorized organization of gambling, participation in unauthorized gambling, or an offense under Section 27 of the Youth Protection Act.
- You must be in orderly financial circumstances: No insolvency proceedings have been opened against your assets or dismissed for lack of assets.
- The premises intended for the operation of the business must meet police requirements in terms of their nature and location and must be suitable for the operation of an amusement arcade.
- Operating your business poses no risk to minors or excessive exploitation of their gambling instincts. Harmful environmental impacts as defined by the Federal Immission Control Act, nor any disturbance to the general public, neighbors, or any public institution, are anticipated.
Documents required
Informal application for a permit to operate an amusement arcade in the traveling trade
- Identity card or passport with registration certificate
- Proof of orderly financial circumstances
- If you are resident in Germany:
- Extract from the debtors' register
- Certificate from the insolvency court
- Certificate in tax matters (from the tax office)
- If you reside abroad: documents proving your sound financial standing.
- Proof of the company's legal form
- If the company is headquartered in Germany: if applicable, an extract from the commercial register, the partnership register or the cooperative register.
- If the company is based abroad: documents from the relevant country proving its legal form
- Proof of personal reliability
- If you are resident in Germany:
- Certificate of good conduct for submission to an authority
- Extract from the Central Business Register for submission to an authority
- If you reside abroad: Documents from your country of residence that prove your personal reliability
- You may be asked to provide further documents.
- Lease, purchase or rental agreement as well as the floor plan of the commercially used premises
- as a legal entity (limited liability company, corporations, public limited company, registered cooperatives):
- Personal documents for all natural persons authorized to manage the business (for example, personal documents, extract from the central business register for submission to an authority)
- Extract from the Central Business Register for submission to an authority
- Partnerships (GbR, KG, OHG, PartG, GmbH & Co. KG) are not eligible for a permit as such. Therefore, each managing partner requires a permit. Please submit a completed application form and all relevant personal documents for each of these individuals.
Please note
If another game with a chance of winning is to be held in the arcade, an additional permit is required.
