Detailed description

A garnishment and transfer order (PfÜB) is a court order issued in enforcement proceedings. It allows you to garnish money or other claims of your debtor.


The garnishment order establishes that a claim of the debtor:

  • It will be seized (it may no longer be used freely) and
  • is transferred to the creditor (the creditor is allowed to collect the money)

Typical examples include account seizure or wage garnishment.


The following are involved:

  • Person or entity demanding money (you as the creditor)
  • Person who owes money (debtor)
  • Entity that owes money to the debtor (third-party debtor), for example:
    • Bank (in case of account seizure)
    • Employer (in case of wage garnishment)
 

Information

Prerequisites

  • They possess an enforceable title to a monetary claim against the debtor, such as...
    • legally binding court ruling,
    • Enforcement order or
    • Notarized debt instrument with enforcement clause.
  • The enforcement title contains an enforcement clause that releases it for enforcement.
  • The enforcement order was duly served on the debtor.
  • The debtor has an attachable claim against someone else (third-party debtor), for example:
    • Account balance at a bank
    • Wage or salary from the employer
    • Claims against insurance companies or clients
  • There are no obstacles to enforcement, for example:
    • statutory exemption limits for seizure
    • existing attachment, which has priority

Documents required

  • Please provide the following information in your application:
    • Name and address of the debtor
    • Amount of claim
    • Title on which the claim is based
    • Name and address of the third-party debtor (for example, bank or employer)
  • Enforcement title with enforcement clause and proof of service
    • If your enforcement order was not served directly by the court, please enclose the original proof of service.
  • Statement of your claims and enforcement costs
    • List your monetary or maintenance claims, as well as any previous enforcement costs (for example, bailiff fees or previous garnishment orders). Include supporting documentation.
    • These costs will then become part of the garnishment and transfer order.
    • You will receive back the documentation you submitted regarding the amount of your previous enforcement costs.

Please note

The enforcement order must have been properly served on the debtor. Without proper service, the garnishment and transfer order is not valid.


They can only seize claims that are legally subject to seizure.

  • Examples: Bank account balances, wages, salary, claims against insurance companies.
  • For example, the following are not subject to seizure: social benefits, child benefits or tax allowances.

Debtors are entitled to protection from seizure.

  • In cases of account seizure, a protected account (P-account) can be set up to secure basic living expenses.
  • In the case of wage garnishment, there are statutory exemption limits that must be observed.

The garnishment and transfer order will be served on the third-party debtor.

  • Make sure you provide the correct address of the bank or employer.

Deadlines

The debtor may file an appeal against the attachment and transfer order (PfÜB) within 2 weeks.

Procedure

  • You apply for the garnishment and transfer order in writing or electronically with the required documents to the responsible authority.
  • The responsible authority will review your application and documents. If necessary, they will request further information or documents from you.
  • The relevant authority will decide on your application.
  • The competent authority issues the garnishment and transfer order.
  • The garnishment and transfer order is formally served on the third-party debtor (for example, bank or employer) by the competent authority.
    • This is done either by mail with proof of delivery or via the electronic government mailbox.
    • If service by direct debit is not possible, it can, in exceptional cases, be served publicly. This is done by posting it on the court's notice board or by electronic publication on the justice portal. The portal will indicate where the garnishment order can be viewed.
  • The third-party debtor is no longer allowed to make payments to the debtor.
  • The third-party debtor informs the debtor about the garnishment, for example by notifying the bank or the employer.
    • The debtor can check whether protection from attachment applies or appeal the attachment and transfer order.
  • The third-party debtor transfers the attachable money directly to you as the creditor.
    • In case of account garnishment: Legally protected amounts remain in the account (garnishment protection account, P-account).
    • In the case of wage garnishment: Only the garnishable part of the salary is paid out.
  • Once the seized money has been transferred, the claim is partially or fully settled.

The processing time depends on the individual case.

Fees

A fixed fee of 24 EUR applies.


Additional costs may be incurred for a bailiff.
