Electronic legal communication is a summary of all (legally) permitted electronic access channels to courts and investigative authorities (e.g. public prosecutor's offices, police, OWi authorities). Access to or the submission requirements for a particular procedure are based on individual federal or state laws.
For participation in electronic legal transactions, according to the applicable legal framework, a so-called secure transmission path (i.e. De-Mail in the form of sender-confirmed or so-called special electronic mailbox) or access via EGVP (electronic court and administrative mailbox) and for the fulfillment of any Written form requirements may require a signature card (qualified electronic signature). Special electronic mailboxes are only available for lawyers (beA), notaries (beN) and authorities (beBpo).

When submitting electronic pleadings, individual submission requirements must be observed (depending on the court / authority / procedural area):
For procedures according to ZPO, partly FamFG, ArbGG, SGG, VwGO, FGO, StPO and OWiG, the requirements of a federal ordinance (ordinance on the technical framework for electronic legal transactions and on the special electronic mailbox (electronic legal traffic ordinance - ERVV) as well as the announcement of technical requirements.
For submissions to the Hamburg trade, partnership and cooperative register, the requirements of a state ordinance (ordinance on electronic legal transactions in Hamburg and the announcement of further technical details) must be observed.
