This means that you are exempt from the provisions of the Shop Opening Act, the Act on Sundays, Public Holidays, Memorial Days and Days of Mourning, the Working Hours Act and the Trade Regulations Act. You can submit the application as a commercial person (natural or legal person). The determination includes the subject, period, opening hours and location of the event. Markets can be fixed for a longer period of time or in perpetuity, provided that there are no conflicting interests in the public interest. Trade fairs and exhibitions, however, only for the events planned within 2 years.
The application for fixing an event is your decision. However, non-scheduled events are subject to the general regulations, for example the travel business card requirement, the Shop Opening Act, the Working Hours Act and the law on the protection of Sundays and public holidays.
If you would like to apply for exceptions to this, you must do so with the responsible authorities.
A determination replaces these individual approvals. You get market privileges from a single source.
However, you also have special obligations to observe when making a determination.
As a rule, we involve and inform the following public authorities for an assessment:
- district offices in whose area the event is to be held,
- Department of the Interior and Sport (BIS Police),
- Authority for Justice and Consumer Protection (BJV Office for Occupational Safety) and
- Hamburg Chamber of Commerce
