Detailed description

If the purchaser of a vehicle does not fulfill his obligation to re-register or de-register, the Landesbetrieb Verkehr (LBV) can initiate the decommissioning ex officio.

The following case constellations come into play here:

  • The previous keeper or owner of a vehicle does not comply with his obligation to notify the registration authority in connection with the sale of his vehicle
  • a vehicle is not immediately re-registered or taken out of service by the purchaser
  • the information provided by the new keeper or owner turns out to be incorrect
  • the vehicle was sold abroad and there is no deregistration

If the decommissioning took place in accordance with Section 13 (4) of the Vehicle Registration Ordinance, the previous owner will receive a notification.

Information

Prerequisites

There is a complete sales announcement (the information on the buyer and the vehicle are complete and correct).

The vehicle is still taxed and insured.

Incomplete sales advertisement
If the information on the purchaser is incomplete or inaccurate, the previous owner must submit an affidavit in lieu of the sale to the LBV. Personal appearance is required for this. The decommissioning will take place at the earliest 3 months after the sale has been announced to the LBV.

Personal application, power of attorney only possible if the holder has submitted an affidavit to a notary in advance:

  • Affidavits can only be given by the holder himself.
  • In the case of legal entities, the insurance is given in lieu of an oath by the person authorized to represent.

Documents required

The following documents must be available:

  • Sale advertisement

Special feature in the case of an incomplete sales advertisement:

  • valid identity card or passport with current registration confirmation
  • an affidavit; this can be handed in directly and personally to the Landesbetrieb Verkehr or via a notary

Application by power of attorney

  • Only possible if the owner (managing director of the company for company vehicles) has submitted an affidavit to a notary in advance and the authorized representative can present it
  • Power of attorney with a legible color copy of the identity of the principal
  • Original identification of the authorized representative

Deadlines

Submission period: 4 weeks

Fees

Depending on the individual case, EUR 30-40. If necessary, additional costs for submitting the insurance in lieu of an oath. The basis for the fee level is the fee schedule for measures in road traffic (GebOSt).
