If a vehicle is defective, the vehicle owner is usually requested by the police or the LBV to remedy the defects or to put the vehicle out of operation. The holder is set a deadline for this. The keeper must act within this period. Otherwise, compulsory measures, such as compulsory decommissioning, are initiated.
If the vehicle is not taken out of service, the owner must provide evidence that the defects have been remedied. This can be done by:
- Copy of the invoice from a specialist workshop showing how the defect has been remedied or
- Copy of the report from an officially recognized expert or auditor that proves that the defect has been remedied.
The proof can be sent by normal post, fax or email to Kfz-Zulassung@lbv.hamburg.de. The documents can also be handed in personally at the information desk of the respective location. Regardless of whether the police and / or the LBV have issued the request to remedy the defect, the LBV should always receive proof in order to avoid unnecessary duplication.
If the vehicle is taken out of service, the defects must be remedied at the latest by the time it is re-registered. Evidence must then be provided at the time of re-admission.
Expired insurance coverage
A registered vehicle must always have insurance coverage so that any damage is covered. If a vehicle is no longer insured, the insurance company notifies the LBV of this. The LBV must take action immediately, as the vehicle is only insured for 1 month after the LBV receives the notification.
The LBV repeatedly requests the keeper to act immediately by setting a deadline by putting the vehicle out of service or providing new insurance cover. Otherwise there is a risk of compulsory decommissioning. There is no extension of the deadline. After all deadlines have expired, the vehicle will be forcibly taken out of service if no new insurance certificate is presented.
If the vehicle is not to be taken out of service, the owner must contact his or a new insurance company and arrange for new insurance cover. The insurance company sends an insurance confirmation electronically for transmission to the LBV. This form of transmission can also be used to provide proof of insurance cover retrospectively, so that insurance gaps are avoided.
In exceptional cases (especially in a hurry), the eVB number can also be communicated to the LBV by fax or by e-mail to Kfz-Zulassung@lbv.hamburg.de.
If an approved vehicle is sold, the new owner must immediately put the vehicle out of service or register it. If the new holder does not meet his obligation, the LBV will issue a request to act. If he lets the set deadline pass, there is a risk of compulsory decommissioning. If a vehicle that has been forcibly taken out of service continues to be driven on public roads, the owner commits a criminal offense.
