Approval of take-back systems for used sales packaging - dual systems

Prerequisites

• Application for approval as a dual system according to § 18 Para. 1 VerpackG
• Proof of financial capacity according to Section 18 (1a) VerpackG
• Commercial register extract
• Appointment of a waste officer according to § 2 No. 3a) AbfBeauftrV
• Public-law contract on the joint use of collection devices for collecting non-packaging of the same material - "Hamburg recycling bin" with the Hamburg AöR municipal cleaning service
• Confirmation of SRH's submission to the applicable voting agreement
• Signed contracts for the collection, sorting and recycling of the waste glass, lightweight packaging and waste paper fractions
• Declaration of submission to the existing coordination agreement with Stadtreinigung Hamburg AöR (as the public waste management authority)
• PPK joint use agreements according to Section 33 (4) VerpackG
• Contract for the acceptance and recycling of used beverage cartons
• Financing agreement with the Central Office for Packaging Register in accordance with Section 18 (1) No. 5 Packaging Act

Documents required

Informal application as well as suitable evidence according to § 18 paragraph 1 and 1a of the Packaging Act (VerpackG). These include:

• Application for approval as a dual system according to § 18 Para. 1 VerpackG
• Proof of financial capacity according to Section 18 (1a) VerpackG
• Commercial register extract
• Appointment of a waste officer according to § 2 No. 3a) AbfBeauftrV
• Public-law contract on the joint use of collection devices for collecting non-packaging of the same material - "Hamburg recycling bin" with the Hamburg AöR municipal cleaning service

Deadlines

The approval only becomes effective after publication in the Official Gazette of the Free and Hanseatic City of Hamburg.

Processing time

Once the documents are complete, the processing time is a maximum of three months.

Fees

The costs are based on No. 2.3.7.1 of Appendix 1 Section 2 Environmental Fees .

Legal remedies

An appeal against an issued decision can be filed within one month.

Systems for taking back sales packaging must be approved by the competent Supreme Waste Management Authority.
