Recognition of Foreign Divorces

Prerequisites

• One of the spouses of the divorced marriage has his habitual residence in Hamburg or Hamburg at the time of the application for recognition
• Neither of the spouses of the divorced marriage has his habitual residence in Germany, but a new marriage is to be concluded in Hamburg

If none of the spouses of the divorced marriage is resident in Germany and no new marriage is to be concluded in Germany either, the Senate Department for Justice in Berlin is responsible.

From September 1st, 2022, the Hanseatic Higher Regional Court will be responsible for the recognition of foreign divorces.

All procedures that have not yet been completed by the authority for justice and consumer protection will also be continued there.
