Detailed description

There are various enforcement measures that may be appropriate or necessary depending on the situation. Which measure is suitable for you depends on what you are owed (money, goods, real estate, income, an action or omission) and what your objective is.



The following options are available:

  • Seizure of movable property, such as cash, jewelry, valuable household items or vehicles
  • Wage and salary garnishment
  • Account seizure
  • compulsory security mortgage
  • Forced auction
  • Receivership
  • Acceptance of the asset disclosure
  • Surrender or replacement of an item
  • The performance, omission, or toleration of a specific action
  • Eviction or surrender of residential and commercial premises
 

Information

Prerequisites

  • They possess an enforceable title (for example, a judgment, enforcement order, court settlement, or notarial deed).
  • The enforceable title includes an enforcement clause that permits enforcement.
  • The enforceable title was duly served on the debtor.
  • The claim or obligation is due.
  • The claim still exists and has not been fulfilled.
    • The requested measure is appropriate to the type of obligation:
    • Money demand
    • Release of an item
    • action, omission or acquiescence
    • Eviction or surrender of premises
  • Certain measures require additional conditions:
    • Knowledge of a third-party debtor in the context of garnishments
    • Unsuccessful enforcement attempt or hopelessness in the case of asset disclosure
    • Property of the debtor in the case of measures against real estate

Documents required

  • Enforceable title in an enforceable version (with enforcement clause and proof of proper service)
  • Statement of the current claim, including a list of any partial payments already made or costs incurred in previous enforcement proceedings.
  • If enforcement attempts have already taken place: documentation of the costs incurred.

Procedure

  • You decide which enforcement measures you wish to take against the debtor.
  • You apply for enforcement proceedings with the required documents at the responsible authority.
  • The responsible authority will review your application and documents, in particular to ensure that all requirements are met. If necessary, they will request further documents or information from you.
  • The relevant authority will decide on your application.
  • The debtor will be informed of the measure and, depending on the case, will have the opportunity to file legal remedies or protective applications, such as an objection, protection against enforcement or protection against seizure.
  • The competent authority orders or carries out the enforcement proceedings.
    • This can include, for example, the seizure of money or property, the service of a garnishment and transfer order on a third-party debtor, the eviction of premises, or the enforcement of an action.
  • The claim has been fully or partially satisfied, or the owed action, omission, or surrender has been enforced.
  • If one measure is insufficient, you can apply for further or different enforcement measures.

Processing time

The processing time for an application for enforcement depends heavily on the type of measure and the completeness of the documents.

Fees

As a creditor, you will generally incur costs during enforcement proceedings. What these costs are and how much they amount to depends on the chosen measure.
