Detailed description

Under the Hamburg Transparency Act, you can request access to the files of the responsible authority under certain conditions. However, certain information may not be released by the authority. Address your request for information to the authority that is required to provide information on your matter.

Prerequisites

The request for information should be made in writing. However, an electronic or oral request is permitted. The information requested should be described as precisely as possible.

Since October 6, 2012, the Hamburg Transparency Act, which replaces the Hamburg Freedom of Information Act, grants everyone free access to official information. You can reach the Hamburg Telephone Service by calling +49 40 42828-0, who will put you in touch with the person responsible for you.

Procedure

  • Apply for information about your file from the authority that is responsible for providing information on your matter. If the authority is not responsible, the authority will identify the responsible authority and advise you.
  • If possible, submit your request for information about your files in writing. You can also submit the request electronically or verbally. Be as precise as possible in describing the information you require.
  • The responsible authority will examine your application.
  • If fees are incurred, you will receive a fee notice.
  • Once you have paid the fees, the agency will provide you with the information and documents you request. Due to legal restrictions, you may not be able to receive all of the information.

Processing time

As a rule, you will receive the information you request within one month. If your request for information is more complex, the deadline can be extended by a further month.

Fees

Fees are usually charged for responding to requests for information. The amount of the fees is based on the fee schedule for information under the Hamburg Transparency Act (HmbTGGebO). Simple information is free of charge.
