Application for a residence permit for third-country nationals in cases of special dependency on a minor child with EU citizenship

As a third-country national or a third-country national with an actual dependency relationship to your minor child who is an EU national, you can obtain a residence permit.

If you come from a third country and have a special relationship of dependency on your minor child who is an EU national, you can obtain a residence permit.

 

Information

Prerequisites

  • Your child holds the nationality of an EU country.
  • There is a special relationship of dependency between you and your child in a legal, economic and/or affective way.

Documents required

  • valid passport or passport substitute from your country of origin
  • valid passport or identity card of your child
  • Your child's birth certificate
  • Proof of your child's special dependency relationship
  • If applicable, proof of maintenance payments.
  • Visa, if required for entry
  • biometric passport photo in electronic form
    • You can have a passport photo taken on site. A photo booth is available.
    • You can have a passport photo taken at a certified photo studio. This photo can then be retrieved electronically from there when you appear for your passport photo.

You may be required to submit further documents. You can find out more when completing the online service or from the responsible authority.

Please note

The residence permit can only be granted if your child, who holds EU citizenship, has an independent right to freedom of movement.

Deadlines

Submit your application immediately after your arrival.

Procedure

  • They use the online service to apply for a residence permit and upload the required documents.
  • The relevant authority will then send you an appointment for a consultation.
  • Please bring all necessary documents, preferably in original form, to the appointment.
  • The relevant authority will verify your identity and documents.
  • The responsible authority will involve other authorities if necessary.
  • You pay the necessary fees.
  • If your application is approved, your fingerprints, signature and a biometric photo will be taken for the production of the electronic residence permit (eAT).
  • The responsible authority commissions an external body, the Federal Printing Office, to produce your eAT.
  • Once your electronic residence permit (eAT) is ready, you can collect it in person from the responsible office. The office will contact you to schedule an appointment. If your application is rejected, you will receive a rejection notice explaining the reasons for the rejection.

Processing time

The processing time varies depending on the individual case and can take several weeks.

Fees

The fees amount to 100.00 euros.


Under certain conditions, a reduction or waiver of fees may be considered.
