Detailed description
You must apply to amend the supplementary provisions if your residence permit contains regulations regarding your place of residence and you wish to move to another federal state. Which office in Hamburg is responsible for your application depends on your specific case.
The Migration Office of the Department of the Interior and Sport (BIS) is responsible for:
- Hardship cases and exceptional hardship cases until the first extension (§ 23a Residence Act (AufenthG))
- Persons seeking temporary protection (§ 24 Residence Act (AufenthG))
- Victims of certain crimes such as human trafficking, undeclared work or illegal temporary employment (§ 25 VI Residence Act (AufenthG))
- Persons subject to enforceable deportation, for whom humanitarian, personal or other legal or factual reasons make departure impossible, until the second extension (§ 25 V Residence Act (AufenthG))
The Hamburg Service is responsible for:
- Individual admissions for reasons of international law or urgent humanitarian reasons (§ 22 Residence Act (AufenthG))
- Admissions from abroad by the highest state authorities (§ 23 I Residence Act (AufenthG))
- Hardship cases and exceptional hardship cases from the second extension onwards (§ 23a Residence Act (AufenthG))
- Admissions in cases of special political interests (§ 23 II Residence Act (AufenthG))
- Resettlement of asylum seekers (§ 23 IV Residence Act (AufenthG))
- Asylum seekers (§ 25 I Residence Act (AufenthG))
- Refugees (§ 25 II Residence Act (AufenthG))
- Subsidiary protection beneficiaries (§ 25 II Residence Act (AufenthG))
- Persons for whom a deportation ban exists (§ 25 III Residence Act (AufenthG))
- Persons subject to enforceable deportation orders, for whom humanitarian, personal or other legal or factual reasons make departure impossible, from the third extension onwards (§ 25 V Residence Act (AufenthG))
- Integrated foreign nationals and certain family members with close family ties in Germany (§ 25a/b Residence Act (AufenthG))
