Detailed description

Every public body is legally required to appoint a data protection officer. The data protection officer is the contact person for all matters relating to data protection. Data subjects can consult the data protection officer on all questions relating to the processing of their personal data and the exercise of their rights under the General Data Protection Regulation (GDPR).



As a citizen, you can contact this office, for example, if you

  • Have questions about whether and how your personal data is processed within the respective administrative unit
  • want to have the legality of the processing of your personal data checked
  • You want to complain about the processing of your data within the respective administrative unit
  • You wish to withdraw your consent to the processing of personal data
  • You would like to be informed about the exercise of your data subject rights (e.g. right to information)

The data protection officer also performs internal administrative tasks. As an employee of the respective administrative unit, you can, for example, contact this office if you

  • Need advice or support on data protection issues.
  • have discovered or suspect a data protection breach

You have a data protection concern that affects the administrative unit to which the data protection officer is assigned.

Documents required

Whether documents are required depends on your request. Often, a brief description of the matter is sufficient for an initial contact. In certain cases, additional documentation may be helpful or necessary. The responsible office will inform you if documents are required.



A declaration of release from the obligation of confidentiality is often required.



If you are contacting the relevant authority on behalf of another person (e.g. family member) and not on your own, you will need a written authorization from that person stating that you are authorized to submit applications and receive responses on their behalf.

There are no universally applicable deadlines. However, it's a good idea to report concerns or complaints as early as possible so they can be reviewed and processed quickly.




In certain cases, such as data protection breaches, you must observe the statutory deadlines for reporting to the supervisory authority or for notifying those affected.

Procedure

  • You contact the responsible department and explain your concerns.
  • The responsible authority will examine your request and determine what measures are necessary.
  • You will receive feedback, advice, or support regarding your concern. If necessary, the data protection officer will coordinate further steps, such as obtaining an internal statement.
