Apply for an extension of your employment toleration

Prerequisites

• Your identity has been verified, for example through a recognized and valid passport or passport substitute.
• You have been in possession of a temporary residence permit for 12 months.
• You have been in employment subject to social insurance contributions (at least 35 hours per week / single parents at least 20 hours per week) for 18 months.
• You can secure your livelihood and health insurance coverage from your own resources without relying on public benefits.
• You have sufficient oral German language skills.
• There are no criminal offenses.
• The children attend school and have not committed any crimes.
• There is no expulsion order/deportation order.
• You have successfully completed the integration course.
• You have sufficient living space for you and your family.
• The Federal Employment Agency has approved the employment.

Documents required

• Valid passport or passport replacement
• Current biometric photo
• Evidence of completed training (e.g. university degree, certificates of completed vocational training)
• For foreign university degrees: Notice of recognition or comparability of the university degree, certificate evaluation from the Central Office for Foreign Education (ZAB) if available
• Employment contract or the declaration of employment relationship completed and signed by the employer
• If applicable, evidence of previous activities (e.g. employment references, employment contracts)
• Proof of German language skills and completion of the orientation course (proof of passing the integration course)
• Proof of securing your livelihood (e.g. equity, blocked account, declaration of commitment)
• Proof of your health insurance
• Current registration certificate

If necessary, the responsible authority will request further documents from you.

Deadlines

You will receive a residence permit for a limited period of time for the duration of your employment, up to a maximum of 30 months.

Procedure

• You can request an appointment by email (bis.asyl-service@amtfuermigration.hamburg.de), and you are welcome to send your documents as an attachment.
• The responsible office will then send you an appointment for an interview.
• Please bring all required documents, preferably in original, to the appointment.
• The responsible authority will check your identity and documents.
• The competent authority shall involve other authorities where necessary.
• If your application is approved, your fingerprints, signature and a biometric photo will be taken to produce the electronic residence permit (eAT).
• The responsible authority commissions an external agency, the Federal Printing Office, to produce your eAT.
• As soon as the electronic residence permit (eAT) is ready, you will receive a notification and can pick it up in person from the responsible office. The responsible office will schedule an appointment for you.
• If your application is rejected, you will receive a rejection notice stating the reasons for the rejection.

Processing time

Processing usually takes about 6 – 8 weeks.

96.00 EUR for a further stay of up to 3 months


93.00 EUR for a further stay of more than 3 months


Certain groups of people may be exempt from the fee. The responsible authority can provide further information.
