Occupational safety inspection in Hamburg

The State Occupational Safety and Health Inspectorate has the legal mandate to monitor occupational safety in Hamburg companies and to advise and support companies in occupational health and safety.

Detailed description

The tasks of the State Occupational Safety and Health Inspectorate can be divided into two groups:

  1. Direct supervision and advice to Hamburg companies and administrations in the implementation of occupational health and safety regulations.
  2. Tasks which are partly related to occupational safety and health and therefore also contribute to safety and health at work, e.g.:
    • Plant safety: Supervision and advice for operators of plants requiring monitoring under the Product Safety Act. This includes elevator systems, pressure equipment, and tank systems.
    • Radiation protection: Supervision and advice for operators who use X-rays or radioactive substances in the fields of medicine, technology and research.
    • Explosives: Supervision and advice on handling explosive substances, for example storage permits, reliability checks.
    • Protection against dismissal: Processing of applications for dismissal of employees on maternity or parental leave.
    • Occupational disease proceedings: Preparation of statements in the context of occupational disease proceedings.
    • Homework: Enforcement of the Homework Act, i.e., supervision and advice for companies that employ employees in homework. Supervision relates to the review of piece-rate and hourly wages and special payments for homework.

The tasks are carried out in the field and in the office.

  • Field service: Inspections of Hamburg companies and administrations, investigation of accidents and special incidents
  • Internal services: Documentation of field services, processing of applications, notifications, inquiries, preparation of statements for building applications or applications under the Federal Immission Control Act.

Here, jurisdiction lies exclusively in the areas of hazardous substances law (e.g., asbestos) and social occupational health and safety (e.g., working hours). All other legal areas fall under the jurisdiction of the Office for Building Regulations and Structural Engineering (ABH) of the Department of Urban Development and Housing (BSW).

Procedure

  • Planning and preparation: The State Occupational Safety and Health Inspectorate plans factory inspections to verify compliance with legal requirements. These include both announced and unannounced on-site inspections.
  • Implementation of the inspection: The processing department carries out the monitoring on site.
  • Detection and punishment of violations: If violations of occupational health and safety regulations are discovered during inspections, these will be documented and punished in accordance with legal requirements.
  • Cooperation with other authorities: Indications of violations in other areas of law are forwarded to the relevant authorities.
  • Follow-up and optimization: The processes and structures of occupational health and safety inspection are continuously reviewed and optimized in order to improve the efficiency and quality of monitoring.
