If you want to have an entry made in the land register, the necessary declarations must be certified or notarized. This particularly applies to registration authorizations from people who will be disadvantaged by the entry.
Examples:
- Cancellation of a mortgage: This affects the creditor. His certified or notarized consent, the so-called cancellation authorization, is required.
- Other necessary declarations: Other declarations required for registration must also be certified or notarized, for example:
- Declaration of conveyance: The agreement between buyer and seller when purchasing a property.
- Declarations of assignment or encumbrance: For example, when a mortgage is transferred.
- Declarations of consent from the owner: For example, when cancelling mortgages, land charges or annuity debts.
- Declarations of unification, attribution and division: When properties are merged or divided.
Certifications and notarizations are carried out by notaries.
