You can have the property registers closed again if all property ownership rights have been combined in your person, i.e. if you are the owner of all the apartments.

It is irrelevant whether you

  • have purchased all condominium rights.
  • who have inherited the property ownership rights.
  • who bought them at the foreclosure auction.

You can also reverse the division if you have always remained the owner of all property rights after a division into condominiums.

An application is required for this.
When the condominium land registers are closed, a new land register sheet is created for the property. Any encumbrances such as mortgages or land charges for all condominium rights with a universal right continue to apply to the undivided property. Individual encumbrances are also taken over if necessary. The encumbrances are therefore transferred to the new land register sheet to be created.

In order to close the property land registers, an application must be made by you or the notary who is certifying the property.

Procedure

  • You must apply for registration at the land registry office. The notary who certified the registration application usually arranges for the registration.
  • The documents are checked by the responsible land registry office.
  • If documents are not complete or in the correct form, the notary's office or you will inform them of this in writing and you will be asked to submit the missing documents or the documents in the correct form (which must be notarized or certified).
  • If all the necessary documents are available, the land registry office will close the condominium land registers and at the same time create a new land register sheet for the property.
  • The successful registration will be communicated to the notary submitting the application and to you with the registration notification.
  • The invoice from the land registry office will be sent to you for payment of the costs.

The processing time depends on the individual case and the workload of the land registry office.

Fixed fee: EUR 50 maximum EUR 500


The land registry office collects a fixed fee separately for the cancellation of each condominium.


In addition to the costs for the work of the land registry office, there are also costs for the work of the notary in accordance with the Court and Notary Fees Act (GNotKG). Please ask the notary who is working on your case for the amount of the notary fees.
