You can have the land registers of shared ownership closed again once all the shared ownership rights have been combined in your person.

You can also reverse the division if you have always remained the owner of all part-ownership rights after a division into part-ownership.

Your application is required for this.
When the partial ownership land registers are closed, a new land register sheet is created for the property. Any encumbrances of all partial ownership rights with a general right, such as a general mortgage, continue with the same content on the undivided property. If necessary, individual encumbrances are also taken over. The encumbrances are therefore transferred to the new land register sheet to be created.

In order to close the part-ownership land registers, an application for entry must be made by you or the notary who is certifying the property.

Procedure

  • You must apply for registration at the land registry office. The notary who certified the registration application usually arranges for the registration.
  • The documents required for registration are checked by the responsible land registry office.
  • If documents are not complete or in the correct form, the notary or you will be informed of this in writing and asked to submit the missing documents or the documents in the correct form (which must be notarized or certified).
  • If all the necessary documents are available, the land registry office will close the part-ownership land registers and at the same time create a new land register sheet for the property.
  • The successful registration will be communicated to the notary submitting the application and to you with the registration notification.
  • The invoice from the land registry office will be sent to you for payment of the costs.

Processing time

The processing time depends on the individual case and the workload of the land registry office.

Fees

Fixed fee: EUR 50, maximum EUR 500.




The land registry office collects a fixed fee separately for the cancellation of each part-ownership.


In addition to the costs for the work of the land registry office, there are also costs for the work of the notary in accordance with the Court and Notary Fees Act (GNotKG). Please ask the notary who is working on your case for the amount of the notary fees.
