Detailed description

A land register extract contains all current entries for a specific property.


It provides information about

  • Location, size and type of use of the property (inventory)
  • the ownership structure (Section I),
  • Burdens and restrictions (Section II), i.e. whether, for example, a right of way, a right of residence or a restriction of disposal is registered and
  • registered land charges (Section III), i.e. whether, for example, a mortgage or land charge exists.

A preliminary notice that secures a planned change of ownership may also be noted.



Since the land register is subject to data protection, you can only obtain an extract from it under certain conditions.



You can obtain a complete land register extract or just individual sections (inventory, ownership, encumbrances and restrictions, mortgages). You can obtain the land register extract as a simple or certified copy.

 

Information

Prerequisites

You can obtain an extract from the land register if:

  • the property or apartment is your property or
  • You are the owner of a right registered in the land register,
  • the property owner has authorized you to do so in writing or
  • There are objective reasons for doing so or you can demonstrate a legitimate interest. This is the case, for example, if you
  • You are a tenant and would like to find out who the actual landlord is.

Mere curiosity or interest in buying is not enough.

Documents required

Please provide the following information in your written application:

  • Property name (land registry district and page number, at least street and house number)
  • if known: information about the property owner
  • Providing the leaf name and district is helpful for quick information.

Please submit the following documents with your written application:

  • Identity card or passport with registration certificate
  • Power of attorney, rental agreement or other proof of your authority, unless you are the owner yourself.
  • Further documents that you can use to prove your legitimate interest include, for example,
    • a rental agreement
    • an enforcement title (court decision)
    • a statement of claim against the owner.

Procedure

  • You submit the application for a land register printout in writing to the responsible authority along with the necessary documents.
  • You can be represented when submitting your application.
  • The competent authority examines the requirements, in particular the existence of the necessary objective reasons or legitimate interest.
  • You will receive an invoice.
  • You pay the cost invoice.
  • You will receive the land register extract.
  • For data protection reasons, the responsible authority usually sends the land register printout by post and not unencrypted over the Internet.

You can also request a land register copy from a notary. If the notary is authorized to use the automated retrieval process for data from the machine-maintained land register, you can also request a land register copy from that notary.

The processing time depends on the individual case.

  • Printout or uncertified copy (copy) from the land register: EUR 10.00

  • Official printout or certified copy from the land register: EUR 20.00
