Detailed description
The arbitration board according to the HmbBGG mediates in conflicts involving possible discrimination against people with disabilities by authorities or public companies of the FHH. The aim is to develop a joint solution to the dispute between the person affected and the relevant public bodies of the Free and Hanseatic City of Hamburg. The arbitration board is independent, acts impartially and offers barrier-free communication in the event of arbitration. Its chairmen are fully qualified lawyers with proven experience in dispute resolution and mediation procedures. It is open free of charge to all people with disabilities and certain associations entitled to bring collective action.
The affected person or the association entitled to bring an action must fill out the application form (available on the website or at the office) and submit it to the arbitration board. The process is generally conducted in writing. If a joint discussion is necessary, the arbitration board will contact you. If the parties to the arbitration process cannot reach an agreement, the arbitrators can make a proposal for arbitration. If you and the affected public body accept the proposal, the arbitration process ends. The result is recorded in writing. If the process fails, you will receive a certificate. The process can be withdrawn at any time free of charge and without giving reasons.
Important: The arbitration procedure is not a substitute for an objection or lawsuit. It is an additional offer of how you can proceed in the event of a perceived violation of law. Contact us if you have any questions about the deadlines for legal remedies.
