Apply for permission for a cultivation association to collectively cultivate and distribute cannabis

If you wish to cultivate cannabis collectively in a growers' association and distribute it to members, you will need official permission.

Detailed description

You can apply for a permit for the communal cultivation and controlled distribution of cannabis if your cultivation association wants to grow cannabis for the personal consumption of its members and distribute it to them.

This permit is for cultivation associations. It allows your association to cultivate cannabis and distribute it to its members. Without this permit, communal cultivation and distribution by your association is not allowed.

You submit the application online via an online service for your growers' association. The application is usually submitted by board members authorized to represent the association externally. These board members can also authorize another person to submit the application on behalf of your growers' association, for example, a lawyer or another third party.

The permit applies exclusively to your growers' association and refers to the cultivation areas specified in the application. It ensures that the communal cultivation and distribution of cannabis takes place within the legal framework.

Information

Prerequisites

Your cultivation association must meet the legal requirements of the Consumer Cannabis Act (KCanG) to obtain a permit. These include, among other things, compliance with safety standards, a health and youth protection plan, and providing information on all paid employees who have access to cannabis and propagation material.

You will receive permission for the communal cultivation and distribution of cannabis if the following legal requirements are met:

  • The authorized representatives of your growers' association have full legal capacity and possess the reliability required for handling cannabis, cannabis seeds and cuttings.
  • You must ensure that the cannabis, cannabis seeds and cuttings in your possession are adequately protected against access by children, adolescents and unauthorized third parties.

They ensure compliance with all other requirements of the Consumer Cannabis Act (KCanG) and the legal regulations issued on the basis of this Act.

If all legal requirements are met, you will receive the permit.

In addition, the following regulations apply according to the Consumer Cannabis Act (KCanG):

  • The growers' association may have a maximum of 500 members.
  • All members are at least 18 years old and have been resident or habitually resident in Germany for at least six months.
  • The statutes of your growers' association stipulate a minimum membership of three months.
  • The cultivation areas maintain a minimum distance of 200 meters from schools, children's and youth facilities and playgrounds.

The permit may be subject to conditions. You must comply with these conditions after the permit has been granted.
