Detailed description
If a claim arising from a legally binding fine is not paid on time, a reminder will be sent to the person liable to pay.
If the payment obligation is not met within one week after receiving the reminder, enforcement measures(for example: account seizure) can be expected.
The court can also order coercive detention.
Coercive detention is not a punishment for the administrative offence committed, but is a deterrent measure if the fine is not paid and the person concerned cannot explain why he or she cannot pay.
In order to initiate enforcement measures, the case is handed over to Kasse.Hamburg as the central enforcement authority of the Free Hanseatic City of Hamburg.
Information on legal force:
- A fine notice becomes legally binding and enforceable if no objection is lodged within two weeks of service (Section 67 OWiG).
- Once the fine notice has become final and binding, it is generally no longer possible to change the amount of the fine or the duration of the driving ban imposed.
- In principle, a legally binding fine notice cannot be revoked or a driving ban can be subsequently converted into a higher fine.
