Obtain information about warning fine certificates in fine proceedings

Detailed description

If violations of the road traffic regulations in stationary and moving traffic are detected by the responsible authorities, administrative offence proceedings are usually initiated.
A distinction is made between administrative offences in stationary and moving traffic.
Traffic violations include violations when parking and stopping vehicles.
Examples of traffic violations include speeding.
Depending on the severity of the violation, a warning or a fine will be imposed.

A warning fine with a hearing is a minor administrative offence for which the authorities can issue a warning fine. A warning fine is set at between €5 and €55 and does not include any administrative costs. As a vehicle owner, you can submit a statement within one week.
The purpose of the warning is to ensure that the procedure is completed quickly and promptly.

The fine must be paid within one week of receipt or a statement must be submitted.

Procedure

The administrative offence is established and the person responsible is identified through an owner inquiry.
For minor fines of up to €55.00, a fine offer with a hearing form will be sent to the vehicle owner.
The vehicle owner has the choice between payment or a statement. This will only be effectively accepted if the fine is paid in full and on time.
Once a statement has been submitted, the competent authority will examine it.
The following results can occur:

  • The objections are acknowledged and the proceedings are discontinued.
  • If a statement does not lead to the discontinuation of the proceedings, a fine notice will generally be sent without further notification. In addition to the fine, this also includes the costs of the proceedings and delivery costs (currently €28.50 according to Section 107 OWiG).
