Apply for temporary registration for extrajudicial legal services.

Would you like to offer legal services temporarily and occasionally and are already working as a legal service provider with a branch in another European country? If so, you must notify the competent authority of this under certain conditions.

Detailed description

In principle, anyone who wants to temporarily provide out-of-court legal services in the following areas must register with the competent authority:
  • collection services,
  • Pension advice in the field of
    • statutory pension and accident insurance,
    • of social compensation law,
    • the remaining social security and severely disabled law relating to a statutory pension as well as company and professional pensions, legal services in a foreign law; if the foreign law is the law of a member state of the European Union or another contracting state of the Agreement on the European Economic Area, advice may also be given in the field of European Union law and the law of the European Economic Area.
Anyone who is legally established in the territory of the European Union (EU), the European Economic Area (EEA) or Switzerland to practice a profession that is comparable to one of the legal services that require registration may occasionally also provide this service in Germany in accordance with Section 15 of the Legal Services Act (RDG). and provide temporarily.
Whether legal services are provided temporarily and occasionally must be assessed in particular on the basis of their duration, frequency, regular recurrence and continuity.

Prerequisites

  • legal establishment to exercise the profession in the territory of the European Union (EU) or the European Economic Area (EEA) or Switzerland,
  • basically an existing professional liability insurance

Documents required

  • Certificate of legal establishment and that carrying out the activity is not prohibited
  • Evidence that the person or company has lawfully practiced the profession for at least one year during the previous ten years, if the profession is not regulated there,
  • If the profession is practiced in the territory of the Federal Republic of Germany: Proof of the existence of professional liability insurance or information as to why taking out such insurance is not possible or unreasonable; otherwise, a declaration that the profession is practiced exclusively from the country of domicile

Procedure

  • The application for registration is to be addressed to the authority responsible for the location of the domestic head office.
  • If a person does not have a branch in Germany, they can submit the application to any authority responsible for the implementation of this Act under Section 19 RDG. The registration procedure can also be processed via a uniform body in accordance with the provisions of the Administrative Procedures Act.
  • The competent authority will examine your application.
  • As soon as all the requirements have been met and all the evidence has been provided, the competent authority will carry out the temporary registration and arrange for it to be publicly announced in the legal services register.
  • You will receive notification as to whether you have been registered.

A decision on the application must be made within a period of three months

A mailbox is available outside of the Joint Acceptance Point's opening hours (Monday to Friday, 6:15 a.m. to 1:00 p.m.). This is located at one of the doors at the main entrance to the Civil Justice Building and is intended solely for mail to the Hamburg District Court and Regional Court. The mailbox is opened at 1:00 p.m. when the Acceptance Point closes. A timer in the mailbox automatically closes a dividing flap at midnight. The mailbox is emptied the next working day, and the contents are stamped with the appropriate incoming mail stamp.
