Communications from medical and dental authorities on protection against the dangers of ionising radiation in the course of quality assurance

As a medical or dental practice, you must report the results of tests carried out as part of quality assurance to protect against the harmful effects of ionizing radiation to the responsible authority.

Detailed description

A notification from the medical or dental authority is required in the following cases:

  • repeated use of ionising radiation with unclear or missing justifiable indication;
  • Determination of persistent, unjustified exceedance of the diagnostic reference values,
  • Failure to take optimization suggestions into account,
  • Deviations from the requirements of medical science
  • lack of cooperation of the person responsible for radiation protection, in particular if he or she fails to comply with his or her obligation to submit the information.

As a medical or dental practice, you do not make any supervisory orders under the Radiation Protection Act (StrSchG) in conjunction with the Atomic Energy Act (AtG).



You are obliged to fulfil the tasks assigned to you, including direct reporting, to the Office for Occupational Safety and Health.

Procedure

The medical and dental authorities are obliged to inform the radiation protection officers in writing about the results of the inspection; errors and deficiencies are listed and their assessment is carried out by means of a classification on the basis of the uniform evaluation system.


The results report must show understandable and targeted ways to optimise, which in particular aim to ensure that

  • the use of ionising radiation and radioactive substances corresponds to the state of the art in medicine or dentistry and the requirements of medical science,
  • the requirements of the StrlSchV for quality assurance and optimisation of the application are observed,
  • the physical and technical tests are carried out properly,
  • the equipment and tools used in the application of radiation correspond to the state of the art or the state of science and technology
  • in the event of unjustified exceedances of the diagnostic reference values, immediate remedial action is taken.

Proposals for short-term measures and changes must be submitted to the radiation protection officer, indicating the consequences (proof of elimination of deficiencies within a certain period of time, follow-up inspection, notification to the supervisory authority).



As a medical or dental institution, you report to the Office for Occupational Safety and Health (BJV):

  • the results of the tests,
  • a compilation of the exposure data collected during the tests,
  • a constant, unjustified exceedance of the diagnostic reference values used in the examination and
  • failure to observe the optimization suggestions.
  • Personal data of the persons examined or treated may not be transmitted.

The responsible authority will check your report. If necessary, the responsible authority will request further documents or information from you.
