Apply for a commercial permit according to explosives law

If you want to handle explosive substances commercially or place them on the market, you need a permit under the Explosives Act.

Detailed description

For the commercial handling and trafficking of explosive substances, you need a permit from the responsible authority. Without a permit, this is prohibited. This permit may contain conditions to avoid dangers, disadvantages or nuisances for others.



You handle explosive substances commercially if you manufacture, process, handle, recover, store, transfer, use, destroy, transport within your premises or receive them for commercial purposes.



You are dealing commercially with explosive substances if you make them available on the market, purchase them, transfer them, arrange for their purchase, distribute them or transfer them to others.

Prerequisites

  • You are at least 21 years old.
  • If you want to carry out the work yourself, you have the necessary specialist knowledge. You can prove your specialist knowledge with a certificate. The certificate confirms your successful participation in a state or state-recognized training course.
  • You are reliable. You have the necessary reliability if you have previously behaved lawfully and have no criminal record.
  • You are personally suitable. You are personally suitable if you have no limitations, for example in your mental or physical health or due to drug or alcohol addiction.
  • They have suitable rooms or storage facilities for storage.

  • Valid identity card or passport
  • Proof of professional qualification or proven expert person (certificate holder)
  • Proof of liability insurance
  • Description of the intended storage (e.g. technical documentation, photo evidence, storage plan)
  • Certificate of clearance
  • To check the reliability of persons from abroad: You need a certificate in a certified translation from the competent judicial or administrative authority in your home country or country of origin about certain facts that are relevant for assessing your reliability (for example, criminal record extract).

Every 5 years, the reliability of the company representatives on the permit is checked again.

Procedure

  • You fill out the relevant application form completely or submit the application online and send it to the responsible authority, including the documents listed in the application.
  • The responsible authority will examine your application and documents. If necessary, it will request further documents or information from you.
  • The responsible authority will decide on your application.
  • You will receive a notification.
  • The fee notice will usually be sent to you later.
  • As soon as you have the permit, you are allowed to handle or transport explosive substances.

Processing usually takes 4 weeks.

Fees apply even if your application is rejected. The amount of the fees depends on the time required.
