Apply for a permit to construct, operate or modify a wastewater treatment plant

If you want to build, operate or significantly modify certain wastewater treatment plants, you must apply for a permit in advance.

Detailed description

For the construction and operation of certain wastewater treatment plants, mostly used industrially, as well as for significant changes to them, you may need a separate water law plant permit. As a rule, you only need the permit for wastewater treatment plants,

  • for which an environmental impact assessment must be carried out, or
  • in which waste water is treated that comes from plants covered by the Industrial Emissions Directive (IED) and for which there is no permit under the Fourth Ordinance on the Implementation of the Federal Immission Control Act (Ordinance on Plants Requiring a Permit - 4. BImSchV), or
  • which treat waste water from a landfill with a reception capacity of at least 10 tonnes per day or with a total capacity of at least 25 000 tonnes.

You must apply for approval from the relevant authority. You must have the approval before you start your project.

Prerequisites

You must construct, operate and maintain wastewater treatment plants in such a way that the requirements for wastewater disposal are met. You must construct, operate and maintain wastewater treatment plants that require approval in accordance with the state of the art.

Documents required

  • Documents on the type and quantity of wastewater, the operation of the plant and the impact on the environment
  • if applicable: existing water law permit or indirect discharge permit

Please note

In some cases, a notification may be sufficient instead of a permit if your project involves a change in the location, nature or operation of a facility that may have an impact on the environment.

The permit requirement applies to independently operated industrial wastewater treatment plants that are not ancillary facilities within the meaning of the 4th Ordinance on the Implementation of the Federal Immission Control Act.

The waste water must originate from one or more plants covered by the Industrial Emissions Directive (IED) and not be subject to the Urban Waste Water Directive (91/271/EEC).

In addition to the permit, you may need a water discharge permit or an indirect discharge permit for discharging wastewater into the public sewer system.

It is advisable to submit the application early, as a wastewater treatment plant may only be operated with a permit.

Procedure

  • It is recommended that you consult the relevant authority prior to submitting your application.
  • You submit a written, informal application to the responsible authority and enclose the necessary documents.
  • The responsible authority will examine your application and, if necessary, request any missing documents or information from you.
  • The responsible authority will inform you of the decision on your application in writing.
