Apply for approval for the construction and operation of plants

If you want to set up or operate systems that can damage the environment to a particular extent or endanger the general public, you need a permit.

Detailed description

If you want to build and operate a facility which, due to its nature or operation, is particularly likely to cause harmful environmental impacts or otherwise endanger, significantly disadvantage or significantly nuisance the general public or the neighbourhood, you will need a permit from the responsible authority. This also includes stationary waste disposal facilities for the storage or treatment of waste.

Prerequisites

  • The plant does not have any harmful environmental impacts that are avoidable given the current state of technology.
  • The plant's unavoidable harmful environmental impacts are kept to a minimum using state-of-the-art technology.
  • They properly dispose of the waste generated during the operation of the plant.
  • Other public law regulations and occupational health and safety concerns do not conflict with the project.

You need approval before you build or put the systems into operation.

Procedure

You submit the application for approval for the construction and operation of facilities requiring approval to the competent authority in writing or electronically.



The authority will examine your application.


If necessary, the authority will request further information or documents from you.



The authority shall publish the application and the accompanying documents and make it available for public inspection for one month.


The authority shall invite the other authorities involved to comment on the authorisation procedure within one month.


Objections will be discussed with you and those who raised the objections at a public hearing.


In a simplified approval procedure or if public participation is waived, there will be no public interpretation or discussion.



The authority will decide on your application. If necessary, the authority will supplement the decision with content and additional provisions.


You will receive a written notice with reasons.


Those who have raised objections will also receive the decision with reasons.

Processing time

The processing time is 7 months with public participation and 3 months in the simplified procedure without public participation.

Fees

Fees apply. The amount of the fees depends on the investment amount or the administrative costs. They are calculated according to the Hamburg Environmental Fees Ordinance.
