Detailed description

If you are legally established as a debt collection service provider in another member state of the European Union, in another state party to the Agreement on the European Economic Area or in Switzerland, you may practice this profession temporarily and occasionally in the Federal Republic of Germany. You are subject to the same rights and obligations as collection service providers registered in Germany.

If neither the profession nor the training for this profession are regulated in the country of establishment, this only applies if you practice the profession in the member state of the European Union, in another contracting state of the Agreement on the European Economic Area or in Switzerland, where you are established, have exercised at least one year during the previous ten years.

Whether legal services are provided temporarily and occasionally must be assessed in particular on the basis of their duration, frequency, regular recurrence and continuity.

Temporary legal services are only permitted if you notify the relevant registration authority in text form before the first provision of services in Germany.

  • if necessary, professional liability insurance with a minimum insured sum of EUR 250,000 for each insured event

Documents required

The notification of temporary legal services must include:

1. Proof of identity - your surname and first name or your company, in the case of legal persons including the legal representatives as well as the registration court and the registration number under which the legal person is entered in the commercial, partnership, cooperative or association register,

2. Proof of the year of foundation, if it is a legal entity,

3. Proof of business address including the addresses of all branches,

4. Proof of a certificate stating that you are legally established in a member state of the European Union, in another contracting state of the Agreement on the European Economic Area or in Switzerland to exercise the profession of debt collection service provider and that you are exercising this activity at the time the submission of the certificate is not prohibited, not even temporarily,

5. Proof that you have lawfully practiced the profession in a member state of the European Union, in another state party to the Agreement on the European Economic Area or in Switzerland for at least one year during the previous ten years if the profession is not regulated there ,

6. If the profession is exercised in the territory of the Federal Republic of Germany, proof of the existence of professional liability insurance or information as to why it is not possible or unreasonable to take out such insurance; otherwise a declaration that the profession is practiced exclusively from the country of domicile,

7. Specification of the job title under which the activity is to be performed in Germany.

The notification must be repeated annually if you wish to provide temporary legal services in Germany again after a year has elapsed.

Please note that a court other than the one listed here may have jurisdiction over your case.

A mailbox is available outside of the joint acceptance point's opening hours (Mon-Fri 6:15 a.m. to 1:00 p.m.). This is located at one of the doors at the main entrance to the civil justice building and is only intended for mail to the Hamburg District Court and Regional Court. The mailbox is opened when the acceptance point closes at 1:00 p.m. A timer in the mailbox automatically closes a dividing flap at midnight. The mailbox is emptied on the next working day and the contents are stamped with the appropriate incoming mail stamp.
