The Hamburg Social Authority does not currently supervise statutory social insurance providers. Complaints are processed by the highest administrative authority responsible for social insurance in the state in which the state-run insurance provider is based. If it is not a state-run insurance provider, the complaint must be addressed to the Federal Office for Social Security. The responsible supervisory authority can usually be found in the imprint on the website of each statutory health insurance provider.
The examination of the complaint does not constitute legal advice and does not replace an objection or a lawsuit. The supervisory authority only acts in the public interest. The responsible supervisory authority is therefore not obliged to take action following a complaint. If there is a violation of law, the responsible supervisory authority will work to ensure that this is remedied by the statutory social insurance provider. However, the supervisory authority cannot make decisions on behalf of the social insurance provider. If the complainant seeks a change in the law, he or she must contact the responsible federal ministry directly. If the statutory social insurance provider extends to more than three federal states, the Federal Office for Social Security is responsible. If not, the respective state's social ministry is usually responsible.
