If you want to employ a pregnant or breastfeeding woman between 8 p.m. and 10 p.m., you need a permit.

Detailed description

If you want to employ a pregnant or breastfeeding woman between 8 p.m. and 10 p.m., you must obtain approval.



If the supervisory authority does not temporarily prohibit the employment, you may employ the woman between 8 p.m. and 10 p.m.



The competent authority may temporarily prohibit you from employing a pregnant or breastfeeding woman during this period in order to ensure the protection of the health of the woman or her child.

Prerequisites

  • You can only submit the application if you are an employer.
  • The pregnant or breastfeeding woman must expressly agree to the planned working hours.
  • The medical certificate must not speak against employment until 10 p.m.
  • It is impossible to place a pregnant woman at unreasonable risk by working alone.
  • There is no risk of irresponsible danger to the child caused by the mother working alone.

  • Evaluation of the working conditions according to § 14 paragraph 1 Maternity Protection Act

Deadlines

You need permission before you can employ a pregnant or breastfeeding woman between 8 p.m. and 10 p.m.

Procedure

You can apply for permission to employ a pregnant or breastfeeding woman between 8 p.m. and 10 p.m. in writing or online.



You can request approval in writing:

  • Please describe your request informally.
  • Send your application, including the required documents and evidence, to the responsible authority.
  • If necessary, the responsible authority will request further documents or information from you.
  • The responsible authority will decide on your application.
  • Your application will be considered approved if you do not receive a rejection within 6 weeks.
  • If the requirements for approval are not met, you will receive a rejection.
  • You may receive a provisional rejection.
  • If your application is rejected, you will receive a rejection letter. You will not receive a letter of approval.
