Apply for official recognition of a qualified person for tests in explosion protection according to the Ordinance on Industrial Safety and Health

Competent persons who want to carry out an inspection after repairs with regard to a part on which the explosion protection depends must be officially recognized.

Detailed description

This administrative service includes the official recognition of a qualified person according to Annex 2, Section 3, Number 3.2 of the Operational Safety Ordinance for inspections of

  • Devices,
  • protection systems or
  • Safety, control or regulation devices within the meaning of the ATEX directive (2014/34/EU)

after repairs to a part on which explosion protection depends.



The information applies to initial applications or applications for renewal.

 

Information

Prerequisites

  • Relevant technical professional training or another technical qualification sufficient for the intended examination tasks.
  • At least one year's experience with the manufacture, assembly, operation or maintenance of the systems or system components to be tested within the meaning of Annex 2, Section 3 of the Ordinance on Industrial Safety and Health.
  • Activity of the person to be approved in the context of the upcoming inspection of the work equipment to be inspected as well as appropriate further training
  • Expert statement on the qualifications of the person to be recognized and on the equipment and quality assurance of the company
  • Evidence of the regular need for such tests
  • Police clearance certificate document type O (for authorities) required

Details of the applicant

  1. Address of the business premises or the business department in which the person authorized to carry out the examination is to work
  2. Details of the contact person for queries
  3. Test tasks and scope for which recognition is requested
  4. Evidence of the need for testing and specification of the devices to be tested, the protective systems, safety, control and regulation devices that are to be tested after repair
  5. Declaration by the applicant regarding the freedom from instructions of the person qualified to carry out the examination
  6. if available, certification document for a quality assurance system or information on the quality assurance procedure

Information about the competent person

  1. First and Last Name
  2. Birthday and place,
  3. profession
  4. Applicant's home address
  5. Copy of the employment contract between the applicant and the person qualified to conduct the examination
  6. Curriculum vitae of the applicant with details of professional career and practice up to the time of application as well as copies of certificates from previous employment relationships
  7. Copies of the skilled worker's certificate, the master craftsman's certificate and certificate, the diploma certificate and certificate or comparable proof of qualification
  8. Copies of certificates of participation in further training measures, relevant exchanges of experience
  9. Police clearance certificate, document type O
  10. Declaration of the person qualified for the examination about the freedom from instructions.

Opinion of an expert


After the scope of the test has been determined by the approval authority, the applicant commissions an expert to submit an expert opinion. This statement refers to the technical and organizational requirements of the company and the examination of the personal suitability of the applicant and his skills and knowledge of the relevant legal norms for the corresponding test work. If the applicant has been accredited as a test laboratory or inspection body according to the standards of the DIN EN ISO/IEC 17000 series, the scope of the expert statement and, if necessary, the sample test will be tailored to this.



Written confirmation from the insurer of existing liability insurance


in the amount of 2.5 million euros for the activity of the recognized person qualified to carry out the examination in accordance with the declaration of exemption

Deadlines

The recognition is valid for 5 years.

Procedure

  1. Submission of the documents with the exception of the expert opinion
  2. Evaluation of the company and the testing workplace by the certification authority and specification of the expert test scope by the certification authority
  3. Commissioning of the expert by the operator
  4. Submission of the report to the Unit for Plant Safety (V21) of the Authority for Justice and Consumer Protection
  5. Notice of acceptance or rejection

Processing time

The competent authority will report immediately.
