Commercial use of protected animals, plants and their products Apply for an exemption

If you want to sell animals, plants or products of a strictly protected species or use them commercially, you must first apply for a marketing permit from the responsible authority.

Detailed description

Since many species are endangered by trade, marketing and commercial use is only permitted under certain conditions. If you want to sell or commercially use animals, plants or products of a strictly protected species, you need a marketing permit. You must have marketing authorization before you begin marketing or commercial use. You must apply for marketing authorization in advance from the responsible authority.

Prerequisites

You must be able to prove the legal origin of the animal, plant or their products.



When handling live animals, the legal minimum requirements for keeping conditions must be met.

Documents required

  • written Application
  • Proof of legal origin, such as
    • Witness statement
    • Declaration of an oath
    • photos
    • The invoice
    • Appraise
  • Information about identification (ring number, transponder, photo, breeding certificate)

Even if all legal requirements are met, you have no right to have the permit issued. The responsible authority decides on each individual case at its own discretion. If you are rejected, you have legal recourse.



Species that are particularly protected are subject to reporting requirements. This means that you must report any entry, exit or loss of a specially protected animal in writing to the responsible authority.

Procedure

  • It is recommended that you contact the responsible authority in advance to clarify the matter.
  • You submit a written application for a permit and submit the application together with the necessary documents to the responsible authority.
  • The responsible office will examine your application and the documents submitted.
  • If the test is positive, you will receive approval and a notice of fees.
  • You pay the administration fees
