Show land lease change

If you have made a change to a land lease agreement, you must report this to the relevant authority.

Detailed description

As a lessor of agricultural land, you must report any changes to an existing land lease agreement to the responsible authority.

As a tenant, you can also inform the responsible authority of this change in the contract.

  • You have modified an existing land lease agreement.

  • Notification period: 1 month after completion of the amendment to the land lease agreement

  • The amendment to the land lease agreement is valid if you have not received a notice of objection from the responsible authority after one month.

    • If the examination takes longer, this period can be extended to 2 months by the responsible authority. You will then receive a written interim decision with a corresponding notification.


Procedure

  • You report the completion of the land lease agreement amendment to the responsible authority.
    • You must indicate an oral amendment to the land lease agreement by means of a substantive notification.
    • Please submit a copy of any amendment to the land lease agreement that has been concluded in writing.
  • After notification of the completed amendment to the land lease agreement, the competent authority registers the basic data and checks whether there is an unhealthy distribution, in particular an accumulation, an uneconomical fragmentation or the lease price is unreasonably high.
    • If the competent authority determines that the change to your land lease agreement has the aforementioned effects, it can object to it and cancel it. You will then receive a notification from the competent authority.

Legal remedies

An application for a decision by the competent local court can be filed against official notifications within two weeks of delivery. The application can be submitted to the authority for the environment, climate, energy and agriculture, Neuenfelder Straße 19, 21109 Hamburg or the corresponding district court.
