Prerequisites
- Living space is every single room that is suitable and intended for residential purposes.
- You must report any vacancy of living space that lasts longer than four months.
- If you are entitled to dispose of the apartment, you must state the reasons for the vacancy and, if necessary, provide proof. You must also provide information about the location of the apartment, its size and furnishings as well as the proposed rent.
- If you as a citizen want to report the vacancy of an apartment that you do not have the right to dispose of, you must at least provide precise information about the location of the apartment.

If you are unable to report online, please contact the local district office in whose area of responsibility the living space is located.
Under certain circumstances, permission may be necessary to leave an apartment vacant due to renovation or new construction. If you report the vacancy due to a specific intention to carry out renovation work or new construction work, the approval is deemed to have been granted if the responsible authority does not object within eight weeks. In the event of an objection, you will receive information about the further procedure from the responsible authority.
Deadlines
At the latest immediately after the apartment has been empty for four months. The start of vacancy is when the last resident moves out; in the case of new buildings, the time when the property is ready for occupancy.
