Detailed description

The properties within the area of a reallocation procedure according to the Building Code (BauGB) are subject to the disposal and change block according to § 51 BauGB. Every single change in the factual or legal situation on the properties in the reallocation area can have consequences for a large number of other decisions. For this purpose, the legal processes and projects listed in Section 51 are subject to approval. Approval is to be granted if there is no reason to assume that the project would make the reallocation impossible or significantly more difficult.

No registration is required to use the application online service.

Please note

The direct beneficiaries of the approval are entitled to apply. In the case of decrees and agreements, these are both contracting parties, in the case of property division the owner, in the case of projects those who want to carry out the project; these can also be tenants or leaseholders, for example. Representatives or authorized persons are also authorized to apply.

Processing time

The processing time for you depends on the type of application. It usually takes between 20 and 30 minutes. Please note that you may have to upload documents.


A decision on approval must be made within one month of receipt of the application by the reallocation agency. The deadline can be extended by a maximum of three months before the deadline by means of an interim notification to the applicant or a person authorized to accept receipt. A decision on the application is usually made before the end of one month.

Fees

No fees are charged.

Legal remedies

In the administrative procedure, an objection can be raised against decisions up to one month after receipt.
